PROBLEMATIC ISSUES OF MODERN TORT LAW OF RUSSIA AND THE EU AGGRAVATED BY THE DEVELOPMENT OF AI SYSTEMS
Aleksandra A. Alimova
MGIMO University
Abstract: artificial intelligence systems are used in transport, healthcare, lending, recruitment and content creation, and their spread is accompanied by a growing number of cases of harm. Neither Russian nor EU law offers a systematic answer to the question of who should compensate such harm and on what conditions. The proposed EU AI Liability Directive was withdrawn in 2025, while Russian Federal Law No. 243-FZ of 2026 deals with liability only by reference to general legislation. The object of the study is to identify the technical and legal features of AI systems that matter for tort law and the problems of modern tort law that these features aggravate. The research objectives are to compare legal, ethical and doctrinal definitions of an AI system and related concepts; to single out the features of AI systems relevant to tort law; to assess their impact on the basis and conditions of tort liability; and to identify the resulting problems. The research methods include the formal legal, comparative and historical legal methods, systemic analysis and generalisation. The findings support a functional approach to the concept of an AI system and propose a working definition for tort law purposes. Nine technical and legal features are identified and grouped into two clusters, and the elements of the liability mechanism affected by each cluster are shown. The structure of the tort remains intact, yet establishing each condition of liability becomes considerably more difficult. Conclusions: the development of AI systems aggravates five groups of problems in tort law: the gap between the person controlling the risk and the person obliged to compensate; the evidentiary gap; the lack of a benchmark of due conduct; the shift of harm towards weakly protected areas combined with its serial nature; and the competition of tort regimes. Solutions should be sought in recalibrating the basis of attribution, the liable subject and financial security within the existing system of tort law.
