ИСТОРИЧЕСКИЕ АСПЕКТЫ РАЗВИТИЯ ПРИНЦИПА САМООПРЕДЕЛЕНИЯ НАРОДОВ

Аннотация. В статье исследуется историческое развитие принципа самоопределения народов – от политико-философской идеи до самостоятельного принципа современного международного права. Цель исследования — проследить генезис принципа самоопределения народов в международном праве и показать, как политико-философская идея, укоренённая в учениях о народном суверенитете, трансформировалась в самостоятельный принцип современного международного права. Методология основана на историко-правовой и формально-юридический методы, толкование договорных источников и анализ судебной практики и доктрины. В работе установлено, что самоопределение восходит к естественно-правовым учениям раннего Нового времени, связывавшим «народ» с народным суверенитетом и правом на сопротивление. В рамках правового позитивизма оно не признавалось субъективным правом народов, что подтверждают решение Постоянной палаты международного правосудия по делу «Лотус»  и доклад по Аландским островам Переход в международно-правовую сферу связан с Уставом ООН 1945 г., деколонизацией и резолюциями Генеральной Ассамблеи, а нормативное закрепление — с общей статьей 1 Пактов о правах человека 1966 г. и Декларацией о принципах международного права 1970 г. Автор заключает, что самоопределение утвердилось как самостоятельный принцип позитивного международного права.

HISTORICAL ASPECTS OF THE DEVELOPMENT OF THE PRINCIPLE OF SELF-DETERMINATION OF PEOPLES

Abstract. This article examines the historical development of the principle of self-determination of peoples — from a political-philosophical idea to an autonomous principle of modern international law. The aim is to trace its genesis and to show how an idea rooted in doctrines of popular sovereignty was transformed into an autonomous principle of international law. The methodology rests on the historical-legal and formal-legal methods, the interpretation of treaty sources, and the analysis of judicial practice and doctrine. The study establishes that self-determination originates in the natural-law doctrines of the early modern period, which linked "the people" with popular sovereignty and the right of resistance. Under legal positivism it was not recognised as a subjective right of peoples, as confirmed by the Permanent Court of International Justice in the Lotus case and the report on the Åland Islands. Its transition into the international-legal sphere is associated with the Charter of the United Nations of 1945, decolonisation, and General Assembly resolutions, while its normative consolidation is linked to common Article 1 of the Covenants on Human Rights of 1966 and the Declaration on Principles of International Law of 1970. The author concludes that self-determination has become established as an autonomous principle of positive international law.
