ИНСТИТУЦИОНАЛЬНЫЕ БАРЬЕРЫ РЕГИОНАЛЬНОГО ИНВЕСТИЦИОННОГО КЛИМАТА: ВЛИЯНИЕ КАЧЕСТВА СУДЕБНОЙ ЭКСПЕРТИЗЫ НА ТРАНСАКЦИОННЫЕ ИЗДЕРЖКИ БИЗНЕСА (НА ПРИМЕРЕ ЮЖНОГО ФЕДЕРАЛЬНОГО ОКРУГА)

Аннотация. Качество деятельности институтов разрешения экономических споров является фундаментальным фактором формирования регионального инвестиционного климата. Судебная экспертиза и аудит выступают ключевым механизмом снижения информационной асимметрии и трансакционных издержек бизнеса. Однако цифровизация экономики и усложнение финансовых схем обнажили проблему пространственной асимметрии рынка экспертных услуг. Цель - выявить и количественно оценить влияние дефицита кадрового и технологического потенциала организаций судебного аудита на рост трансакционных издержек бизнеса в регионе (на примере Южного федерального округа). Исследование базируется на институциональном подходе и теории трансакционных издержек. Эмпирическую основу составили данные социологического опроса 47 практикующих экспертов, анализ кейсов трех экспертных организаций и статистика арбитражного судопроизводства. Для оценки конкурентоспособности экспертных институтов применена авторская интегральная модель. Доказано, что дефицит IT-компетенций судебных экспертов (оцениваемый в ЮФО в 9,2 балла из 10) ведет к систематическому затягиванию судебных процессов и росту издержек ex post. Установлено, что повышение индекса кадрового потенциала (Kкад) на 20% обеспечивает рост доли заключений, принимаемых судом без замечаний, с 82% до 91%, что напрямую снижает финансовые и временные потери сторон спора. Преодоление институциональных барьеров на рынке судебной экспертизы требует перехода от чисто нормативного регулирования к инвестициям в региональный человеческий капитал. Предложены меры по созданию межрегиональных центров компетенций и внедрению дифференцированной аккредитации, что будет способствовать улучшению инвестиционного климата макрорегиона.

INSTITUTIONAL BARRIERS TO THE REGIONAL INVESTMENT CLIMATE: THE IMPACT OF FORENSIC EXPERTISE QUALITY ON BUSINESS TRANSACTION COSTS (CASE STUDY OF THE SOUTHERN FEDERAL DISTRICT)

Abstract. The quality of economic dispute resolution institutions is a fundamental factor in shaping the regional investment climate. Forensic examination and audit are key mechanisms for reducing information asymmetry and business transaction costs. However, the digitalization of the economy and the increasing complexity of financial systems have exposed the problem of spatial asymmetry in the expert services market. The objective of this study is to identify and quantify the impact of a shortage of human and technological capacity in forensic audit organizations on the growth of business transaction costs in the region (using the Southern Federal District as an example). The study is based on an institutional approach and transaction cost theory. The empirical basis consists of data from a sociological survey of 47 practicing experts, an analysis of cases from three expert organizations, and arbitration court statistics. A proprietary integrated model was used to assess the competitiveness of expert institutions. It has been demonstrated that a shortage of IT competencies among forensic experts (estimated at 9.2 points out of 10 in the Southern Federal District) leads to systematic delays in litigation and increased ex post costs. It has been established that a 20% increase in the human resources capacity index (Kcad) leads to an increase in the proportion of unqualified opinions accepted by the court from 82% to 91%, which directly reduces the financial and time losses incurred by parties to a dispute. Overcoming institutional barriers in the forensic examination market requires a shift from purely normative regulation to investments in regional human capital. Measures are proposed to create interregional centers of excellence and introduce differentiated accreditation, which will contribute to improving the investment climate in the macroregion.
