В статье поднимаются проблемы обеспечения баланса публичных и частных интересов в финансовой сфере, неотъемлемой составляющей которой являются кредитные правоотношения. Рассмотрены особенности взаимодействия сторон кредитных правоотношений (кредитора и заемщика), основанных на принципах автономии воли, равенства субъектов правоотношений, защиты частного интереса и юридической определенности. В статье осуществлен анализ перспектив достижения баланса публичных и частных интересов кредитных правоотношений в условиях цифровизации. Автором предлагается комплексный подход по достижению баланса публичных и частных интересов в кредитных правоотношениях, основанный на сотрудничестве государства с кредитными организациями, внедрении цифровых технологий в деятельность государственных органов, регулирующих кредитные правоотношения, и повышении финансовой грамотности населения.
This article addresses the challenges of balancing public and private interests in the financial sector, an integral component of which are credit relationships. It examines the interactions between parties to credit relationships (lender and borrower) based on the principles of autonomy of will, equality of parties, protection of private interests, and legal certainty. The article analyzes the prospects for achieving a balance between public and private interests in credit relationships in the context of digitalization. The author proposes a comprehensive approach to achieving a balance between public and private interests in credit relationships, based on cooperation between the state and credit institutions, the implementation of digital technologies in the activities of government agencies regulating credit relationships, and improving the financial literacy of the population.
