В статье рассматривается история становления институтов местного самоуправления в английских графствах, а также особенности их организации и деятельности. Развитие английского местного самоуправления имеет глубокие исторические корни. На первом этапе развития местного самоуправления в графствах (V-X вв.) главным источником правового регулирования местного самоуправления были англосаксонские правды. В правдах нашло закрепление новое административно-территориальное деление на графства и сотни, а также структура, полномочия и порядок деятельности органов местного самоуправления. Начиная с XII в., в качестве источников правового регулирования местного самоуправления, все большую роль начинают играть судебные прецеденты, королевские акты, а затем с XIV в. статуты – совместные акты короля и парламента. Целью работы является анализ особенностей правового регулирования английского местного самоуправления. Задачи включают анализ теоретической основы английского местного самоуправления; исследование правовой базы регулирования институтов местного самоуправления; изучение принципов организации и деятельности, структуры и полномочий местных органов власти и управления на различных этапах исторического развития Англии. В ходе исследования использовались как общенаучные, так и специально-юридические методы исследования: диалектический, логический, формально-юридический, сравнительно-правовой и другие. В статье проанализирована специфика правового положения и характер взаимоотношений должностных лиц и собраний графств и сотен с королевской властью. Особенности исторического развития и правового регулирования деятельности органов местного самоуправления привели к складыванию англосаксонской модели местного самоуправления, одной из характерных черт которой является высокая степень автономии по отношению к центральным органам власти и управления.
The article examines the history of the formation of local government institutions in English counties, as well as the features of their organization and activities. The development of English local government has deep historical roots. At the first stage of local government development in the counties (5th-10th centuries), the main source of legal regulation of local government was the Anglo-Saxon laws. The laws enshrined a new administrative-territorial division into counties and hundreds, as well as the structure, powers and procedures for the activities of local government bodies. Beginning in the 12th century, judicial precedents, royal acts, and then statutes - joint acts of the king and parliament - began to play an increasingly important role as sources of legal regulation of local government. The aim of this paper is to analyze the specific legal framework for local government in England. The objectives include an analysis of the theoretical foundations of English local government; a study of the legal framework regulating local government institutions; and an examination of the principles of organization and operation, structure, and powers of local authorities and governance at various stages of England's historical development. In the study, both general scientific and specially legal research methods were used: dialectical, logical, formal-legal, comparative-legal and others. The article analyzes the specifics of the legal status and the nature of the relationship between officials and assemblies of counties and hundreds with the royal power. The peculiarities of the historical development and legal regulation of the activities of local government bodies led to the development of the Anglo-Saxon model of local government, one of the characteristic features of which is a high degree of autonomy in relation to central authorities and administration.
