В статье авторам рассмотрены теоретические основы расследования преступлений, совершенных этническими организованными преступными группами. В рамках данной статьи проанализированы понятие этническая преступность, мнения отдельных ученых по ее содержанию. Определены признаки, характеризующие данный вид противоправных деяний, выявлены основные направления деятельности этнической преступности на современно этапе, установлены проблемные аспекты доказывания по делам исследуемой категории. По итогам исследования дано уточненное понятие организованная этническая преступность, выявлены основные направления по повышению эффективности расследования преступлений, совершенных преступными группами на этнической основе.
In the article, the authors examine the theoretical foundations of investigating crimes committed by ethnic organized criminal groups. Within the framework of this article, the concept of ethnic crime and the views of individual scholars regarding its content are analyzed. The characteristics that define this type of unlawful act are identified, the main areas of activity of ethnic crime at the present stage are revealed, and problematic aspects of proving cases in this category are established. Based on the results of the study, a refined definition of organized ethnic crime is provided, and the main directions for improving the effectiveness of investigating crimes committed by criminal groups on an ethnic basis are identified.
