В статье исследована проблема соотношения конституционно-правовых традиций и инноваций в современных социальных системах, когда конституционализм от моноцивилизационного (западного) этапа развития перешел к этапу полицивилизационного развития, охватив более 200 стран планеты из разных цивилизаций. В условиях глобализации происходит нарастающий социальный обмен достижениями человечества, в том числе, в социально-правовой, конституционно-правовой сферах. Для отдельных стран и цивилизаций основу составляет их правовая традиция, а инновации представляют те новшества в конституционно-правовых системах, которые постоянно возникают в процессе развития и которыми идет обмен между социально-правовыми системами разных стран и цивилизаций. Такие инновации могут быть как адекватными, так и неадекватными по отношению к конституционно-правовым традиционным основам принимающего социума (страны-реципиента). В этой связи, в процессе социально-правового обмена требуется экспертный анализ содержания инокультурных инноваций-заимствований (как правовых рецепций) на предмет их соответствия существующей конституционной традиции принимающего социума.
This article examines the relationship between constitutional and legal traditions and innovations in modern social systems, where constitutionalism has transitioned from a single-civilization (Western) stage of development to a multi-civilization stage, encompassing more than 200 countries across the globe from diverse civilizations. In the context of globalization, there is an increasing social exchange of human achievements, including in the socio-legal and constitutional-legal spheres. For individual countries and civilizations, their legal tradition forms the foundation, while innovations represent those new developments in constitutional and legal systems that constantly emerge during the development process and are exchanged between the socio-legal systems of different countries and civilizations. Such innovations can be both adequate and inadequate in relation to the traditional constitutional and legal foundations of the host social system (recipient country). In this regard, in the process of socio-legal exchange, an expert analysis of the content of foreign cultural innovations-borrowings (as legal receptions) is required for their compliance with the existing constitutional tradition of the receiving social system.
