Цель: теоретико-методологический анализ подходов к определению эффективности правовых норм и выработка оснований для оценки эффективности декларативных норм права. В статье рассматривается специфика декларативных норм, выявляются препятствия, возникающие при оценке их эффективности (отсроченный характер реализации, идеологическая составляющая, сложности квантификации). Проводится критический анализ четырех основных научных подходов к эффективности права. Сделана попытка обосновать, что плюралистический подход наиболее полно отражает природу декларативных норм права. Отмечается важность разграничения юридической и социальной эффективности. Предлагаются качественные критерии оценки эффективности декларативных норм. Сделан вывод о том, что под эффективностью декларативных норм можно понимать комплексную характеристику их способности благоприятно воздействовать на объективную действительность через закрепление ценностных ориентиров и снижение социальной конфликтности.
Тheoretical and methodological analysis of approaches to determining the effectiveness of legal norms and development of grounds for assessing the effectiveness of declaratory norms of law. The article examines the specificity of declaratory norms, identifies obstacles arising when assessing their effectiveness (delayed nature of implementation, ideological component, difficulties of quantification). A critical analysis of four main scientific approaches to the effectiveness of law is carried out. An attempt is made to substantiate that the pluralistic approach most fully reflects the nature of declaratory norms of law. The importance of distinguishing between legal and social effectiveness is noted. Qualitative criteria for assessing the effectiveness of declaratory norms are proposed. It is concluded that the effectiveness of declaratory norms can be understood as a comprehensive characteristic of their ability to favorably influence objective reality through the consolidation of value orientations and reduction of social conflict.
