Актуальность настоящего исследования обусловлена необходимостью надлежащего правового регулирования процессуального положения лиц, вовлеченных в стадию возбуждения уголовного дела, но не обладающих статусом участников уголовного судопроизводства. Такое регулирование является залогом обеспечения их процессуальных прав и эффективной реализации целей и задач данного этапа. Фрагментарность правового статуса заявителя в уголовном процессе препятствует полному гарантированию его прав, свобод и законных интересов, что негативно сказывается на качестве и полноте доследственной проверки и усложняет достижение назначения уголовного судопроизводства. Целью исследования являлось выявление особенностей правового регулирования процессуального положения заявителя на стадии возбуждения уголовного дела, анализ его участия в данном процессе. В рамках исследования рассматривалось содержание и значение квалифицированной юридической помощи для обеспечения прав и законных интересов лиц, участвующих в уголовном судопроизводстве. Сделаны выводы о целесообразности уточнения понятия «заявитель», установления его правового положения на стадии возбуждения уголовного дела, а также сформулированы предложения по совершенствованию законодательства в части определения его процессуального положения и обеспечения полноты в осуществление его законных прав.
The relevance of the present study is due to the need for proper legal regulation of the procedural position of persons involved in the stage of initiating a criminal case, but who do not have the status of participants in criminal proceedings. Such regulation is the key to ensuring their procedural rights and the effective implementation of the goals and objectives of this stage. The fragmented legal status of the applicant in the criminal process hinders the full guarantee of their rights, freedoms, and legitimate interests, which negatively affects the quality and completeness of the pre-investigation check and complicates the achievement of the purpose of criminal proceedings. The purpose of the study was to identify the features of legal regulation of the applicant's procedural position at the stage of initiating a criminal case, and to analyze his participation in this process. The study examined the content and significance of qualified legal assistance in ensuring the rights and legitimate interests of individuals involved in the criminal proceedings. The conclusions are made about the expediency of clarifying the concept of "applicant", establishing his legal status at the stage of initiating a criminal case, and formulated proposals for improving legislation in terms of determining his procedural status and ensuring the completeness of his legal rights.
