Актуальность. Необходимость проведения подлинных, открытых и справедливых выборов – задача, исполнение которой невозможно в формате замкнутой системы отношений. В своем изначальном понимании идея наднационального контроля за организацией избирательного процесса была продиктована стремлением создать инструмент по обеспечению демократических начал. Вопреки ожиданием, развитие транснациональных связей не способствует качественному улучшению системы электорального мониторинга, но порождает ряд политических коллизий. В этой связи, особый интерес представляет современное состояние рассматриваемого института, его значение для существующей модели межгосударственного взаимодействия. Цель: настоящая публикация посвящена научному анализу проблем политико-правовой адаптации института международного наблюдения в контексте существующих глобальных вызовов. Автор обращает внимание на исключительную значимость регионального фактора как условия, лежащего в основе современной модели наднационального электорального мониторинга. Отмечается роль отдельных ведущих геополитических центров, таких как ОБСЕ, ЕС, СНГ, а также группы негосударственных акторов в сфере организации избирательного процесса. На основе проведенного исследования формулируются выводы относительно специфики современного состояния института иностранного (международного) наблюдения. Методы: в процессе проведенного исследования автор использовал общенаучные (анализ, синтез, индукция и дедукция) и специально-научные (эвристический и аксиологический) методы познания, а также метод контент-анализа. Результаты исследования: в публикации представлен анализ актуальных правовых материалов надгосударственного характера, свидетельствующих о трансформации самой системы избирательных отношений, выходе ее за рамки вопросов сугубо национального характера. Выводы: материалы публикации могут быть использованы при проведении научных исследований в областях международного и избирательного права, а также для более углубленного изучения в ходе преподавания учебных дисциплин, предметом которых выступает изучение динамики развития избирательного права на современном этапе общественных отношений.
Relevance: The need for genuine, open and fair elections is a task that cannot be carried out in a closed system of relations. In its original understanding, the idea of supranational control over the organization of the electoral process was dictated by the desire to create a tool to ensure democratic principles. Contrary to expectations, the development of transnational relations does not contribute to a qualitative improvement of the electoral monitoring system, but generates a number of political conflicts. In this regard, the current state of the institution in question and its significance for the existing model of interstate cooperation are of particular interest.Purpose: This publication is devoted to a scholarly analysis of the political and legal adaptation of the institution of foreign (international) election observation in the context of existing global challenges. The author emphasizes the exceptional importance of the regional factor as a fundamental condition underlying the contemporary model of supranational electoral monitoring. Particular attention is paid to the role of major geopolitical centers, such as the OSCE, EU and CIS, as well as to groups of non-governmental actors involved in the organization of electoral processes. Based on the conducted research, conclusions are drawn regarding the specific features of the current state of the institution of foreign (international) election observation. Methods: In the course of the study, the author employed general scientific methods (analysis, synthesis, induction, and deduction), specialized scientific methods (heuristic and axiological approaches), as well as the content analysis method. Research Results: The publication presents an analysis of current supranational legal materials demonstrating the transformation of the electoral relations system itself and its evolution beyond issues of an exclusively national character. Conclusions: The findings of this publication may be used in further research in the fields of international law and electoral law, as well as for more in-depth study in the teaching of academic disciplines concerned with the dynamics of the development of electoral law at the present stage of social relations.
