Статья посвящена теоретическим и прикладным аспектам индивидуального предупреждения самоуправства. С учетом специфики данного вида преступного поведения, детерминируемого различными факторами, обоснована необходимость усиления индивидуального предупреждения самоуправства. На основе анализа положений криминологической доктрины, нормативных актов и правоприменительной практики предложена комплексная модель индивидуального превентивного воздействия, включающая этапы от раннего устранения детерминант конфликта до превентивного принуждения и поощрения правомерного поведения. Показано, что в индивидуальном предупреждении самоуправства ключевое значение имеют адресные меры убеждения, оказания помощи, принуждения и поощрения, реализуемые в форме профилактической беседы, правового информирования, оказания помощи и т.д. Сделан вывод, что эффективное предупреждение самоуправства требует интеграции правовых мер с коррекцией мотивации личности и оказанием реальной помощи в защите законных интересов субъекта.
The article is devoted to the theoretical and applied aspects of individual prevention of arbitrariness. Taking into account the specifics of this type of criminal behavior, determined by various factors, the need to strengthen individual prevention of arbitrariness is substantiated. Based on the analysis of the provisions of criminological doctrine, regulatory acts and law enforcement practice, a comprehensive model of individual preventive action is proposed, including stages from the early elimination of conflict determinants to preventive coercion and encouragement of lawful behavior. It is shown that targeted measures of persuasion, assistance, coercion and encouragement, implemented in the form of preventive conversations, legal information, assistance, etc., are of key importance in the individual prevention of arbitrariness. It is concluded that effective prevention of arbitrariness requires the integration of legal measures with the correction of individual motivation and the provision of real assistance in protecting the legitimate interests of the subject.
